RESTRICTED Agencies with a statutorily required deadline to examine an OMC in a given year should request to join the OCOE as a participating state agency and note the corresponding statutory requirement. See Lead State Agency and Participating Agency Selection for more information. Maximum Number of Participating State Agencies The number of participating state agencies on an OCOE should not exceed 10. All state agency requests to participate in an OCOE will be considered by the MMC. Nothing in this Protocol shall prevent or limit a state agency in any way from exercising its legal authority over an OMC. The MMC, at its discretion, may implement an exception to the 10-state agency limit on an OCOE in instances where an agency (or agencies) must meet a statutorily required examination deadline, or when special circumstances require additional agencies to participate. Lead State Agency and Participating Agency Selection Each OCOE is limited to 10 participating state agencies, including the Lead or EIC state agency. If more than 10 agencies express interest in participating in an OCOE, the following selection criteria waterfall is used to prioritize and determine the 10 participating agencies. By default, state agencies that fall within the top four categories of this waterfall will be selected as participating agencies for the scheduled OCOE.

*Scenario: An agency able to offer an examiner with critical subject matter expertise in relation to the scope of the examination will be given priority to participate in the OCOE. **Scenario: If an agency expresses interest in participating in only one of 10 OCOEs scheduled in an examination cycle, the agency will likely be given priority to participate in that OCOE over other agencies expressing interest in participating in more than one OCOE in the same examination cycle. **Scenario: An agency that expresses interest in participating in its first OCOE will be given priority to participate in the OCOE over a state agency that has participated in OCOEs in the past.
