• Was the disclosure provided to borrowers who, based on their credit report, receive material credit terms less favorable than better qualified borrowers? • Did the disclosure contain all required elements? • Was the content of the disclosure accurately based on the borrower’s credit report? NOTE: Determining which borrowers need to receive the notice requires in-depth comparisons of the types of terms offered by the person offering credit and to which borrowers.
