DFI Trust Company Examiner’s Entry Checklist

20 CAPITAL A. Most recent capital adequacy plan, along with related policy including maintenance plans, dividend philosophy, and contingency sources. B. History of entries to capital accounts since the prior examination. C. Listing of any off balance sheet items or contingent liabilities, if applicable. D. Direct counsel(s) handling fiduciary matters for the Company to forward a letter to the examiner-in-charge describing any threatened and/or pending litigation against the Company in connection with its fiduciary activities. Please direct counsel to include therein: 1. Identification of accounts concerned, 2. The nature of the action, 3. The amount involved, 4. The present status of the action, and 5. A statement as to the probable outcome of the action, together with its cost to the Company. E. Stress testing performed to determine ongoing capital adequacy.
