• DIDMCA allows state banks to “export” interest rates to other state. “Interest” includes periodic rates, late fees, NSF fees, and other charges. • Opt-out states: lenders risk lawsuits or enforcement if charging above state caps. • Industry argument: Affirmance will improve access to credit. • Implications extend beyond Colorado. – Other states and D.C. are considering DIDMCA opt-outs. • If Colorado wins and sets off a trend of other states opting out, we may see some state-chartered banks pursue a national charter.
